3. Engagement Process

Engagement with Selene commences when you request our services and we confirm our acceptance in writing. Initial consultations may be provided on a no-obligation basis to assess your matter. Once engaged, our relationship will be governed by:

  • Our written engagement letter specifying scope and fees
  • Our Privacy Policy
  • Professional responsibilities under Hong Kong law

4. Fees and Payment

4.1 Pricing Structure

Fees for our services are structured as follows:

  • Banking & Finance Advisory: HKD 10,140 (fixed fee for standard matters)
  • Employment Handbook Development: HKD 4,290 (fixed fee)
  • Mediation Services: HKD 3,510 (hourly rate)

Complex matters may require adjusted fees. Any additional costs will be discussed and approved in advance.

4.2 Payment Terms

Invoices are issued upon engagement or completion of services. Payment is due within 30 days of invoice date. We accept bank transfer and major payment methods.

4.3 Expenses

In addition to service fees, you may be responsible for reasonable out-of-pocket expenses including travel, third-party consultations, and administrative costs.

5. Limitation of Liability

Our liability for any breach of these terms is limited to the fees paid for the specific service in question during the 12 months preceding the claim. We are not liable for:

  • Indirect, incidental, or consequential damages
  • Loss of profits, revenue, or business opportunity
  • Damages arising from decisions made based on our advice
  • Any matter arising from your non-compliance with our recommendations

This limitation does not apply to personal injury, death, or fraud.

6. Disclaimers

6.1 No Guarantee of Results

We cannot guarantee specific outcomes. Our services are provided on a "best efforts" basis reflecting professional expertise and experience. Outcomes depend on many factors beyond our control, including actions by other parties and decisions by courts or authorities.

6.2 No Professional Relationship Unless Engaged

No professional relationship or duty arises from your enquiry unless we confirm our engagement in writing. Initial information provided is educational only and does not constitute legal advice.

7. Intellectual Property

All work product, advice, documents, and materials created by Selene during our engagement remain our intellectual property unless otherwise agreed. 8. Confidentiality

We maintain strict confidentiality regarding all client information in accordance with professional standards and Hong Kong law. Information disclosed in confidence to us will be protected. However, confidentiality may be overridden where:

  • Preventing serious harm to persons
  • You give written consent to disclosure

9. Conflict of Interest

We will disclose any potential conflicts of interest that may arise during our engagement. If a conflict cannot be managed through informed consent, we may decline the engagement. We do not act simultaneously for both sides in a dispute.

10. Your Responsibilities

You agree to:

  • Provide complete and accurate information relevant to your matter
  • Disclose all relevant facts and circumstances
  • Make timely decisions and follow our advice
  • Pay fees in accordance with agreed terms
  • Maintain confidentiality of our work and advice

11. Termination

Either party may terminate the engagement with written notice. Upon termination, you remain responsible for fees for work completed. We may retain documents as required by professional obligations or law.

12. Governing Law and Jurisdiction

These Terms & Conditions are governed by the laws of Hong Kong. You agree to submit to the exclusive jurisdiction of the courts of Hong Kong for any disputes arising from this agreement.

13. Dispute Resolution

Before initiating legal proceedings, we encourage resolution through good faith discussion. If disputes cannot be resolved informally, parties may pursue mediation before litigation.

14. Changes to Terms

We may update these Terms & Conditions from time to time. Changes are effective upon posting to our website. Continued use of our services constitutes acceptance of updated terms.
